Hi,
Hopefully a simple one.
Company van had an accident on the way to their workplace - a site
a car pulled out in front of the van so no fault on our team.
but this has resulted in our guys being off for over 7 days .
does this Lost time go against the company stats as a Road traffic accident?
i just need a steer on how to report / show?
thanks
T

Morning T,
Few points to think of here.
Were the guys "commuting" i.e. travelling to normal place of work or considered as working while travelling to a work site?
If the latter, definitely work related injuries and should be recorded as such.
A caveat though, some companies do record commuting accidents as work related.
Assuming classed as work related, I would report as a non-fault travelling accident.
Is there any dashcam footage available to conclude no fault of your driver?
Confirmed your driver was not distracted i.e. food, drink, phone, sat nav?
If you wanted to go belt and braces, driver licence checks on the driver(s), vehicle in MOT date and serviced.
If over 7 days and work related makes it RIDDOR reportable...or does it if RTA??
Regards
BS

I would consider that the guys were traveling to their place of work- therefore not reportable? and no lost time recorded.Blackstone wrote: ↑Thu Feb 15, 2024 6:40 am Morning T,

definitely no fault of our guys based on investigation.
always find that its confusing the travelling to and from work/ traveling for work under Riddor

Always a 'grey area'
Particularly when traveling to work in a company vehicle.

Grey indeed!
The way I understand it is that if I was travelling to the normal site i work at it's commuting.
If I then travel to another work site on occasion, my travel is counted as "work" .
I have worked for a couple of Swedish multi-nationals and they reported any commuting accident in their workplace stats.
Might be making a broad statement here, but I don't think the majority of UK companies report commuting accident in workplace stats.

Yeah, there's always been a bit of a UK / rest of EU divide on this one. Most EU countries would say it's work, but AFAIK we would not.
We often think that when we have completed our study of one we know all about two, because 'two' is 'one and one.' We forget that we still have to make a study of 'and.'
