Oil Storage

HI
I am in the midst of an ISO14001 audit, we have had the accreditation since 2009 and until today we have had the same external auditor. We also have a group wide external consultancy who informs us of all legal changes and updates and maintains our legal register.

On site we have a 4500 litre diesel tank which is double skinned. We have never had any issue with the EA or past auditors with it but today the ISO auditor insisted that it needs to be bunded? He says that this is in the Oil storage regs. I asked our external consultant and he says that we do not need a bund, the secondary skin will suffice.

Can anyone point me to the right answer please?

My initial thought was just because it has always been that way is it right?

Depending on where you are (England & Wales, NI or Scotland) the regulations may have slight variation.

The regs state:

You must install secondary containment around your container to catch any oil that leaks.

Secondary containment is usually either:

a drip tray beneath the container
a bund - an outer case which holds the container
Fixed tanks must be bunded. Other containers can be bunded or use drip trays.

Secondary containment does not include:

‘double-skinned’ or ‘twin-walled tanks’, where the tank is surrounded by a second outer skin for extra strength
