Good afternoon learned ladies and gents.
Got a quandary that I'm hoping a CDM expert can advise me on.
We are mid way through a project that is over running. We are the Principal Contractor. The Client wants to bring in some contractors to carry out a job on the site which is nothing to do with our scope of works. This was scheduled in previously and we should have been off the site by now.
I'm not happy about this as I do not want us to cop for the Principal Contractor responsibilities for an activity outside of our control. My suggested course of action is to suspend our status of Principal Contractor for the site for the duration of this activity and for us to vacate the site for as long as is necessary, documenting this and ensuring we have evidence of agreement from the client. The client can then take control of the site, carry out the required work and we will come back when it is complete.
Is there any issues in regards tot he CDM regs with us doing this?

Not a CDM expert by any means but a similar situation a couple of years back on site. We were having some water tanks replaced and needed to carry out some work in the CDM area over a weekend. The appointed
Principal Contractor wrote to us as the client and confirming that we as the client would accept transfer of of Principal Contractor from date to date, signed by us and to accept the responsibility of the area. Come the Monday morning our responsibility ceased and the original principal contractor resumed. Can you not do this so that you are not held responsible for the CDM area whilst the works are ongoing?
