I don’t really know where to put this but I am placing it here and if it needs moving elsewhere please do.
So I started up my limited business offering health safety and well-being advice and training services, I finally start my first contract on Monday ... yay
At 5pm today, on a Friday, I receive an email from someone who has trademarked my limited company name and they are demanding I change the name.
I know I need to get legal advice but it won’t be at least until Wednesday that I can do that and I need some advice.
She has trademarked the name and I haven’t (but others have the same name on the trademark list), on first inspection our businesses look similar but she is environmental health and food safety, I am health, safety and well-being- nothing to do with food.
She has trademarked a few clauses, my one clause as we discovered today would be different to any of hers...
The other businesses with the same name have different clauses to her. If that makes sense
Is there anyone out there with trademark knowledge that could advise? I’m really worried, my partner says because we are different I should be fine - I need to hear it though
Her website says. Company name exists to help food businesses, along the South coast and countrywide, be compliant with food safety laws and guidance
My website says Company name work in the capacity of retained Health & Safety Advisors for many companies, but also on an ad hoc basis, completing everything from site safety audits to safety statements and risk assessments.
Any thoughts are welcome

Just to be clear they trademarked it before I set it up at companies house as a limited company - which they have not done

Trademarks and Copyright are a complex area.
For example, is it just the name, or is there a font/logo involved?

I've not looked into trade marking much at all I'm afraid. I wouldn't know where to start
