prohibition notices

Afternoon All

quick question, if there is a subcontractor carrying out work on your behalf and they are found by the HSE to be breaching legislation and a prohibition notice is served, who would the responsibility of the notice lie with? is it you or the subcontractor?

I assume this is not because you have been issued a PN, because if you had, you would know the answer.
The PN will state exactly who it is against and what it is for.

You will see that it says things like 'by you or under your control'.

So in the circumstances you describe, I would expect it to be raised against the controlling organisation and the responsibility lies with that entity.

This one was raised against a PC on a construction site for W@H issues.
