HSE would want to know why the procedure was not followed. They are very unlikely to accept that this was entirely due to the individual choosing to violate a procedure and would expect there have to have been deeper root causes and contributory factors within your management and systems.

To revisit this briefly.
Although not exactly what the OP was after, one came up on SHP the other day where the company and an individual worker were found guilty of a death with the worker getting a prison sentance (suspended) not the directors of the company.

I think it's a good example to show employees that they can be held directly responsible for their actions and being part of the company wont necessarily protect them.
