CDM - Principal contractor?

Morning All

Quick CDM Question, if a company wins a job where they will be the only ones working on the site but do not use empliyees for the work but sub contractors instead, would this mean that they are then the Principal Contractor?
the Sub Contractor would be working under the RAMS of the people they are working for.

If they are the only ones working on site - why would there be sub contractors?
And sub contractors should be submitting their own RAMS?

Hi

thanks for your reply.
ok so for certain jobs that we take on we may have a supervisor on site who is an employee but if we are short on empoyees to carry out the work then we have sub contractors who carry out the work under the supervisors supervision and working under the RAMS which we have written for the job.

Hi Mike - if your firm have been authorised to complete the work and you subcontract, then yes you would be deemed the PC.

I am a bit concerned that the subbies would be using your RAMS instead of their own. They should submit their RAMS - as after all they are the "professionals" and you should review and ask for clarity or discuss what you want from them and agree the way forward.

I have been in your position before and if the subbies cant / wont submit RAMS I would not consider them for the work - especially high risk work like Confined space entry or work at height.

we work as subcontractors on sites , but use subcontract labour who work to our SSoW.

Agree nige they should follow your ssow - but RAMS?

RAMS = SSoW just another name for the combined RA MS Coshh Assessment etc

I see it slightly different nige - SSOW is a system that should be robust and consistent. The system will dictate what to do in the event of an incident or change in the task requirements etc. How the permit system is managed etc. These should never change

RAMS are procedural and allow flexibility in the way a task is carried out under the SSOW system?
