Re: Asbestos - Duty for domestic properties
You will have to be careful if the asbestos is in a domestic property - the true domestic landlord has no duties under Regulation 4, they do, as Kevlarion suggested have expilicit duties under CDM - Regulation 10 is quite specific and the client comissioning any construction/maintenence work for a c...

Re: still waiting
10 weeks turnaround time generally - the papers may only just have been marked and returned to NEBOSH - they will still need moderating.

Re: CDM Notification period
Hi BP, there is no set period, the regulations require that Principal Contractors and Contractors are given "reasonable" time to prepare. If it's a small extension type job a week may be ok, if it's a dry dock for a nuclear submarine then you could be looking at a year. It really depends o...

Re: Is a an excavator lifting a load defined as a crane.
Excavators can be used as lifting appliances - when they are LOLER applies, which means they have to have a 12 monthly thourough examination, check valves and a lifting plan to name but a few things. It also means that all of your lifting tackle such as strops and shackles has to have 6 monthly thor...

Re: Football injuries..
Going back to the main issue - is there someone at fault? - potentially - Is there the basis for criminal or civil action - potentially. We need to look at facts rather than offering speculative opinions - there are case precedents out there, we need to find them. Firstly we need to put the issue in...

Re: Asbestos
The management plan is a requirement of the CA Regs. It does not have to complicated but has to allow for regular inspection of the ACMs Direct from Regulation 4 CAR 2006 (8) Where the assessment shows that asbestos is or is liable to be present in any part of the premises the dutyholder shall ensur...

Re: Competence of the assessor
Cheers Nick, my memory is obviously failing as I get older........ Amongst other things.
I feel the need to point out to students of NEBOSH that for Fire Risk Assessments there is a defined need for competence as it is in the RRFSO and it is explicit rather than implicit.

Re: Competence of the assessor
Staright form the Management Regs ACoP: Suitable and sufficient 13 ‘Suitable and sufficient’ is not defined in the Regulations. In practice it means the risk assessment should do the following: (a) The risk assessment should identify the risks arising from or in connection with work. The level of de...
