Acts and Regulations are an absolute and must be followed. The guidance is the HSE interpretation of what is required and if you dont follow it, you will have to show why.

Enzo It sounds like your SMT have serious training needs when it comes to H&S. I would get them all to go on the Directing or Leading Safety courses which will tell them what their duties are when it comes to H&S and where the buck actually stops. To be honest I thought the first paper was one of the more difficult ones and the afternoon quite fair, but then again it just depends on how well you had studied!
