prosecutions against individuals

Post by Coldrop »

Morning all

Anyone got any links to HSE prosecutions against individuals rather than companies.. I'm reading the HSE prosecution website but as I dont have any names etc. its like a needle in a haystack

i.e. the foreman/site manager etc was prosecuted (as well as/instead of the company)

Cheers

I believe this was the first case against a director.

J Armour v. J Skeen (Procurator Fiscal, Glasgow) (1977).

He was prosecuted under Section 37(1) of the Health and Safety at Work, etc. Act 1974 which imposes personal liability on senior executives.
SAFETY NEVER SLEEPS.

I did a search for Section 7 of HSWA, is this any good for you?

That was a nice insight Jack... I also found a way to search for people that have been imprisoned ... mostly unlicensed people working with gas appliances, but also a few company directors for breaching improvement and prohibition notices.
If it isn't broken, that doesn't mean you can't improve it. (Do three negatives make a positive ?)

Hey Coldrop

type 'hastam all entries' into your search engine. You will have to redirect onto the new page but once there it is a great database of all matters/incidents/reports//press releases/prosecutions to do with H&S. If you type in for example s7 in the HASTAM search box it gives pages and pages of individuals and companies who were prosecuted. I find it much easier to use than the HSE search facility. Really good database.
../.

Cheers
