20 December 2004 - Health and Social Care Bill Published in Scotland for Smoking Ban

The controversial ban on smoking in public places within Scotland sees the publication of a Health and Social Care bill, to be implemented in spring 2006.

Under the regulations, the ban will be on such places as the following:

  • Wholly enclosed and to which the public, or a section of the public, has access
  • Premises which are being used wholly, or mainly, as a place of work by persons who are employees
  • Premises which are being used by, and for the purposes of, a club or other unincorporated association
  • Premises which are being used wholly, or mainly, for the provision of education, health or care services.

However, there will be exemptions, some of which are long-term care homes and hospices.

Enforcement officers will have powers to enter premises which may create offences such as the following:

  • The permitting of others to smoke in no-smoking premises
  • The smoking in no-smoking premises
  • The failing to display warning notices in no-smoking premises
  • The failing to give name and address on request by an enforcement officer.
