The new Export and Import of Dangerous Chemicals Regulations
2005, revoking and replacing the Export of Dangerous Chemicals Regulations 1992
(SI 1992 No. 2415), will come into force on 22 April 2005.
The new regulations apply to Great Britain, making provisions
which are necessary for the operation in Great Britain of import and export of
dangerous chemicals, to establish a similar procedure for chemicals qualifying
for PIC status and to maintain a common export notification procedure for
chemicals either banned for use, or whose use is severely restricted within the
Community.
Some of the provisions within the new Regulations are as
follows:

Export close to expiry date.

Packaging.

Labelling.
-
Safety information.
-
Storage information.
-
Information on quantities traded.

Information and assistance to developing countries and transit
information.
The Regulations also state the following:

The Health and Safety Commission (HSC) will be the designated
national authority for the administration.

The HSC will be the designated national authority responsible
for the control of the import and export of listed chemicals.

The Health and Safety Executive (HSE) will have the duty placed
on them to arrange for the enforcement of the Regulations.

The enforcement and offences of the Health and Safety at Work,
etc Act 1974 will apply as if they were health and safety regulations made under
s.15 of that act, subject to a provision that breach of the export restriction
will be subject to enforcement under the Customs and Excise Management Act 1979
and not as a contravention of a health and safety regulation.
