Recent Legislation

The Management of Health and Safety at Work (Amendment) Regulations 2006
  • These new regulations amend the Management of Health and Safety at Work Regulations 1999 (MHSWR) (SI 1999 No. 3242). The amendment modifies regulation 22 of MSWHR, which had been amended by Management of Health and Safety at Work and Fire Precautions (Workplace) (Amendment) Regulations 2003 (SI 2003 No. 2457).

The amendment of regulation 22 of MHSWR permitted civil claims to be brought against employers and employees who are in breach of duties imposed on them by MHWSR. The amendment provided that claims could not be brought against employers insofar as the duty applies for the protection of persons not in their employment.

The new regulations extend to employees that protection to exclude the right of third parties to seek damages from employees in breach of their duties under regulation 14 of the MHSWR.
