The Disability Discrimination Code of Practice (Public Authorities) (Duty to Promote Equality) (Appointed Day) Order 2005
  • This Order sets 5 December 2005 for the coming into effect of the Code of Practice on the duty to promote disability equality entitled "The Duty to Promote Disability Equality: Statutory Code of Practice (England and Wales)".

    The code provides practical guidance to public authorities subject to the duties imposed by the Disability Discrimination Act 1995, as amended, and in the Disability Discrimination (Public Authorities) (Statutory Duties) Regulations 2005 (SI 2005 No. 2966).

The duties dealt with in the Code include:

  • promote equality of opportunity between disabled persons and other persons
  • eliminate discrimination that is unlawful under the Act
  • eliminate harassment of disabled persons that is related to their disabilities
  • promote positive attitudes towards disabled persons
  • encourage participation by disabled persons in public life
  • take steps to take account of disabled persons disabilities, even where that involves treating disabled persons more favourably than other persons

A further Code of Practice, giving practical guidance to Scottish public authorities and to cross-border authorities as regards their functions in Scotland concerning non-reserved matters, is to be issued by the Disability Rights Commission in due course.
